The UN Working Group on Arbitrary Detention has considered a complaint filed in defense of Sergei Tikhanovsky on the fact of his arrest at the pre-election picket on May 29, 2020, and his preliminary detention in a criminal case, which was accompanied by a violation of a number of his fundamental rights.
UN experts came to the following conclusions: the Belarusian authorities violated the International Covenant on Civil and Political Rights provisions, to which Belarus is a participant. The deprivation of liberty of Sergei Tikhanovsky was found to be contrary to Articles 2, 7, 9, 10, 11, 19, 20, 21 of the Universal Declaration of Human Rights and Articles 2 (1), 9, 14, 19, 21, 25 and 26 of the International Covenant on Civil and Political rights that are arbitrary and fall under categories I, II, III, and V.
The Working Group asks the Government of Belarus to take the steps necessary to immediately remedy Tikhanovsky's situation and bring it into line with relevant international standards, including those set out in the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights.
"The appropriate remedy would be to immediately release Mr. Tikhanovsky and grant him an enforceable right to compensation and other reparations by international law." In the current context of the global coronavirus (COVID-19) pandemic and the threat it poses in places of detention, the Working Group calls on the government to "take urgent action to ensure the immediate release of Mr. Tikhanovsky."
